On the 19th of April 2016, the German Chamber Shanghai in cooperation with econet hosted a joint workshop  Legal & Tax / Construction & Building Operation under the supervision of Mr. Roger Haynaly (Partner, Rödl & Partner). Over 30 participants joined the event to learn about the new PRC environmental regulations and the practical consequences for production companies.

Mr. Sebastian Wiendieck gave an overview of the legal framework and the relevant authorities.  A wide range of governmental institutions are involved in environmental sector with oftentimes overlapping with responsibilities of other institutions/ministries. Particular important institutions for companies in China are the Environmental Protection Bureaus (EPB) and the Ministry of Environmental Protection (MEP). Elaborating on the required permits and approvals, Mr. Wiendiek explained in detail the legal basis, assessment scope and procedure for the Environmental Impact Assessment Pollutant Discharge Permit, the Project Completion Approval and the Pollutant Discharge Permit.

Giving an analysis of the recent reform of the PRC Environmental Protection Law, Mr. Wiendiek introduced the changes regarding various requirements concerning i. a. emission prevention, internal organization and penalties.

Recommendations about conduction of self-assessments, selecting the right location and environmental due diligence were followed by a Q&A with the audience. Participants took the opportunity to raise questions and shared their experience in the related field.
